Buster Limited trading as B-LOCKS: Terms for use of website and for online sales
Parties
- Buster Limited trading as B-LOCKS (B-locks) is the owner and publisher of the content in this website. The sale and purchase of goods via this website is subject to these terms. These terms also any other retail sales and the use of the website.
- In these terms “you” means anyone who visits or uses this website
Legal Capacity
- Anyone purchasing through this website must be eighteen (18) years of age or over. By making a purchase through this website you confirm that you are eighteen years or older.
Orders and Contract
- B-LOCKS may contract with you for the supply of goods through this website by:
- You placing an electronic order for products using the website and making payment in full (including any delivery charges that may apply) via the website.
- B-LOCKS accepting your order and communicating that acceptance to you.
- B-LOCKS will generally communicate acceptance of your order to you via e-mail. B-LOCKS may refuse to accept an order at its discretion and is likely to do so if we have insufficient product in stock and / or the delivery is not practical within a reasonable period of time.
- At this stage we can accept orders for delivery within New Zealand only.
Prices
- The price shown on our website is in New Zealand Dollars and includes GST. If the price is stated to include delivery costs then delivery costs are included in the price. If delivery costs are not stated to be included then they are additional and are at your cost. Goods will not be dispatched until we have received payment in full.
Supply & Delivery
- Title to the goods supplied will be deemed to pass to you on receipt of payment and dispatch of goods to you.
- We use [New Zealand Post] for delivery unless we advise you otherwise. Delivery is subject to the usual [New Zealand Post] Terms and Conditions. We do not accept any liability for any failures or delays in delivery by New Zealand Post or any other delivery contractor.
Consumer Guarantees Act
- If you purchase goods from us as a consumer (as defined in the Consumer Guarantees Act 1993) then you will have the rights provided for in the Consumer Guarantees Act 1993 and we will honour our obligations to you under the Consumer Guarantees Act 1993. If you acquire goods from us for business purposes then the provisions of the Consumer Guarantees Act 1993 will not apply between B-LOCKS and you.
Privacy and Personal Information
- Your privacy is important to us and we will honor our obligations under the Privacy Act 1993. We will collect personal information from you (which may include your name, residential or postal address, telephone number and email address) for the purpose of accepting your order and sending goods to you. You also agree that we may use your email address to send you messages about your order and messages about products that we supply. If you do not wish to receive promotional or other information from us then please let us know. We may also contact you via telephone regarding your order.
Disclaimer and Limitation of Liability
- B-LOCKS liability to you is limited to replacing faulty goods or refunding the amount paid by you for those goods. If the law does not permit the limitation in the previous sentence then B-LOCKS liability is to the maximum extent permitted by law. B-LOCKS will not be liable for an indirect or consequential loss caused by goods supplied.
- B-LOCKS will not be liable to you for any loss or damage at all arising directly or indirectly out of your use of our website including where your credit card is used fraudulently or its use in unauthorised.
- Our products are children’s toys and are supplied for use as a children’s toy only. We make no representation at all that they are suitable for any other use. If you wish to use our products for any other purpose then you must make this known to us before we agree to supply them to you and we may decline to supply them to you in those circumstances.
Returns
- We accept returns in line with the Consumers Guarantee Act 1993 o.
General
- Your use of this website and any purchases you make from B-LOCKS will be governed by the laws of New Zealand.
- The contents of this website and all data collected from it belong to B-LOCKS. You are granted a licence to view this website and to make orders through it only. You are not to make any other use of its contents.
- By ordering through B-LOCKS website or making an order by contacting B-LOCKS by email, telephone or otherwise you will be deemed to have accepted these terms.
- These terms may be amended by B-LOCKS from time to time at its sole discretion. You are deemed to have accepted any such changes if you make an order after those changes have been made. Consequently you should check these terms before making any new order.
20 If B-LOCKS fails to enforce any terms or to exercise its rights under these terms at any time, it has not waived those rights.
- If any provision of these terms is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms.
